These Terms & Conditions ("Terms") govern your use of the Thesos website, web app, and related services (together, the "Service"). By accessing or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. About Thesos

Thesos is a digital wellness tool that helps people with IBS discover patterns between their lifestyle and symptoms. Thesos is not a medical device, does not provide medical diagnosis, and is not a substitute for professional medical advice, examination, diagnosis, or treatment. Always seek the advice of a qualified clinician with any questions you have about a medical condition.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Thesos. By using the Service, you confirm that you meet this requirement.

3. Your account

When the Service requires an account, you are responsible for the information you provide and for keeping your login credentials secure. You agree to give accurate information and to notify us of any unauthorized use of your account.

4. Acceptable use

You agree not to:

• use the Service in any way that violates applicable law;
• attempt to access, probe, or scan the Service in ways not intended by us, or interfere with its operation;
• reverse-engineer, copy, or redistribute parts of the Service except as expressly permitted;
• upload content that is unlawful, infringing, harmful, or that misrepresents another person.

5. Subscriptions and payments

Paid features of Thesos are governed by our Subscription Terms and Refund Policy, which are incorporated into these Terms by reference.

6. Your content

You retain ownership of the logs, notes, and other content you submit to Thesos. You grant us a limited license to host, process, and display that content only as needed to operate and improve the Service for you. You can request deletion of your content at any time, subject to our retention obligations.

7. Intellectual property

The Thesos name, logo, software, design, and the analyses we generate are owned by Thesos and protected by applicable intellectual-property laws. Nothing in these Terms transfers any ownership of the Service to you.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The insights provided by Thesos are statistical in nature and may be wrong. You are responsible for any decision you make based on them.

9. Limitation of liability

To the maximum extent permitted by law, Thesos and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you have paid us for the Service in the 12 months preceding the claim.

10. Changes

We may update these Terms from time to time. If a change is material, we will give you reasonable notice in the app or by email. Continued use of the Service after the change takes effect means you accept the updated Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to other users or to us.
